He is charged with illegal business activities.Guo spoke out during the hearing, denying the charges, retracting the confession he previously made under torture, and criticising the court.“Judging by the fact that 90 per cent of the 175 interrogations to which I have been subjected during my 10 months in detention were about human rights issues, it is clear that this is a case of political persecution,” he told the court. “I doubt the fairness of this trial because of the presence in the courtroom of two prosecutors against whom I brought complaints and for this reason, I refuse to answer the questions of the court and the prosecutor,” Guo added, prompting the decision to suspend the hearing.His wife, Zhang Qing, is afraid that his courtroom comments could lead to reprisals against him in the coming days. “It is likely that he will be tortured again,” she said. She wrote to United Nations special rapporteur Manfred Nowak last month accusing her husband’s jailers of torturing him.His lawyer, Mo Shaoping, fears that the court will decide to make an example of him and impose an extremely severe sentence.Arrested in September 2006 for criticising the authorities on the Internet and because of his human rights activities, Guo has been repeatedly tortured while in detention. The Single Bench expressed that in imposing a sentence under Section 138 of the Negotiable Instruments Act, while the Court must be alive to the concern of the Legislature in inserting Chapter XVII in the Act and then amending the provisions thereof to make the same more stringent as well as the jurisprudential principles of deterrence and restoration, the court cannot lose sight of the fact that the offence is “quasi criminal” in nature. The Court was of the view that the sentence imposed must be commensurate with the crime committed and in accordance with jurisprudential justification such as deterrence, retribution or restoration, and accordingly, mitigating circumstances as well as aggravating circumstances should also be kept in mind. The revision petitioner before Justice Sudhir Mittal was the accused, having issued a cheque dated 22.4.2006 to the complainant–respondent which was dishonoured. Once the notice demanding payment of the cheque amount was not responded to, the respondent filed a complaint under Section 138 of the Negotiable Instruments Act, 1881. The complaint was dismissed and the petitioner was acquitted vide judgement dated 25.02.2014. However, appeal against the said judgement was allowed on 20.10.2015 and the case was remanded for a fresh decision. Post remand, vide judgement dated 8.7.2016, the petitioner was convicted and sentenced to undergo rigourous imprisonment for a period of two years. He was also directed to pay compensation equal to the cheque amount along with interest at the rate of 9% per annum from the date of cheque till the date of the judgement. Appeal against the aforementioned judgement of conviction was dismissed vide judgement dated 21.8.2019 leading to the filing of the present revision petition. To determine the jurisprudential justification/principle which would apply, Justice Mittal proceeded to examine certain statutory provisions: The Single Judge appreciated that Chapter XVII comprising Sections 138 to 142 was inserted vide Amendment Act 66 of 1988 w.e.f. 1.4.1989. Section 138, as it stood at the time of its insertion, provided for a maximum sentence of one year or fine or both. Vide amending Act 55 of 2002, the maximum sentence was increased to two years and Sections 143 to 147 were inserted. Section 143 provides for summary trial by the Judicial Magistrate, Ist Class or the Metropolitan Magistrate provided the maximum sentence of one year is imposable and fine exceeding Rs.5000/-. For speeding up the process of trial, Section 144 provides for service of summons by speed post or approved courier services. Section 145 provides for submission of evidence on affidavit. Section 143-A and 148 were inserted vide amending Act 20 of 2018 providing for award of interim compensation at the trial stage and for deposit of minimum 20% of the compensation amount awarded, at the appellate stage. “The amended provisions reveal the legislative intent of expediting the trial and of making the sentence deterrent”, remarked the Single bench. Remarking that the concern of the Legislature is “obvious”, Justice Mittal reflected that the provisions inserted for “inculcating greater faith in banking transactions” needed “more teeth” so that cases involving dishonour of cheques were reduced. “It is, thus, apparent that deterrence and restoration are the principles to be kept in mind for sentencing”, concluded the bench, adding that at the same time, the Court cannot lose sight of the fact that the offence under Section 138 of the Act is quasi criminal in nature and that Section 147 of the Act makes the offence compoundable notwithstanding anything contained in the Code of Criminal Procedure, 1973. The bench considered that in the instant case, the maximum sentence of rigorous imprisonment for two years has been imposed on the ground that the offence is a socio economic offence and no other consideration has weighed with the trial. Besides, Keeping in view the principle of restoration, compensation of payment of the cheque amount along with interest @ 9% per annum from the date of issuance of cheque till the date of the judgment has been awarded. “The award of compensation is justified and reflects a judicious exercise of mind”, said Justice Mittal. However, in view of the nature of the offence as well as the fact that the cheque amount is only Rs. 4 lacs, the award of maximum sentence is held to be arbitrary. “Mitigating circumstances argued by counsel for the petitioner such as the petitioner being a poor person and having undergone a protracted trial of almost 10 years, also exist”, noted the bench. The court observed that it is the statutory as well as constitutional duty of  the police to investigate on receiving report of the commission of a cognizable offence.In this case, the police had filed a closure report against one of the accused on the ground that there was no concrete evidence of conspiracy against him and that the informant had not placed any materials before the police direct or indirect with regard to the conspiracy. The bench also comprising Justices Navin Sinha and Krishna Murari observed:We are constrained to record that the investigation and the closure report are extremely casual and perfunctory in nature. The investigation and closure report do not contain any material with regard to the nature of investigation against the other accused including respondent no.5 for conspiracy to arrive at the conclusion for insufficiency of evidence against them. The closure report is based on the ipse dixit of the Investigating Officer. The supervision note of the Senior Superintendent of Police (Rural), in the circumstances leaves much to be desired. The investigation appears to be a sham, designed to conceal more than to investigate. The police has the primary duty to  investigate on receiving report of the commission of a cognizable offence. This is a statutory duty under the Code of Criminal Procedure apart from being a constitutional obligation to ensure that peace is maintained in the society and the rule of law is upheld and applied. To say that further investigation was not possible as the informant had not supplied adequate materials to investigate, to our mind, is a preposterous statement, coming from the police.In this regard, the bench referred to judgment in Manohar Lal Sharma vs. Principal Secretary (2014) 2 SCC 532. The Court also appointed Satyarth Anirudh Pankaj, I.P.S. as the senior officer, State of Uttar Pradesh to carry out further investigation in the matter through a team of competent officers to be selected by him of his own choice. While setting aside the closure report as against the accused, the bench further observed: The police has a statutory duty to investigate into any crime in accordance with law as provided in the Code of Criminal Procedure. Investigation is the exclusive privilege and prerogative of the police which cannot be interfered with. But if the police does not perform its statutory duty in accordance with law or is remiss in the performance of its duty, the court cannot abdicate its duties on the precocious plea that investigation is the exclusive prerogative of the police. Once the conscience of the court is satisfied, from the materials on record, that the police has not investigated properly or apparently is remiss in the investigation, the court has a bounden constitutional obligation  to ensure that the investigation is conducted in accordance with law. If the court gives any directions for that purpose within the contours of the law, it cannot amount to interference with investigation. A fair investigation is, but a necessary concomitant of Articles 14 and 21 of the Constitution of India and this Court has the bounden obligation to ensure adherence by the police.CASE:  AMAR NATH CHAUBEY vs. UNION OF INDIA [ SLP (CRL.) St Aldates closed after police incident

first_imgSt Aldates is currently closed to traffic following an incident involving a pedestrian on the corner of the High Street and St Aldates.The Oxford Bus Company has since confirmed that one of its coaches was involved in an incident with a female pedestrian on the High Street.An X90 coach has been cordoned off at the top of St Aldates, although pedestrians are now able to use the road again.No students are confirmed to have been involved, but it is advisable to avoid the area whilst the police incident is ongoing.Thames Valley Police and the Oxford Bus Company have been contacted for comment.last_img

Freeholder Candidates Face Off in Debate

By MADDY VITALEThere were the pleasantries, some jokes and even agreement between Cape May County Republican Freeholder incumbents Gerald Thornton and E. Marie Hayes and their Democratic challengers Joyce Gould and Elizabeth Casey during a debate Tuesday night.But there were also a few jabs. With less than a week away from the election, the candidates answered a lot of questions, giving their positions on homelessness, the opioid crisis, veterans issues, the condition of the county’s bridges, taxes, school issues, immigration policy, nepotism and open space.It was standing room only at the Historic Court House building on Main Street in Cape May Court House, where people came to listen to the four square off.The League of Women Voters moderated the debate.Thornton, the freeholder director, began serving on the board in 1976. He served through 1987 and then again from 1995 to present. He is a proud veteran and is very active in supporting the counties military community.He has been a freeholder through many changes in the county, he noted.Thornton told the audience why he wanted to continue to serve.“I love the position I am in. I love to help and care for people. I want to thank you for giving me the opportunity to serve,” Thornton said.Hayes, of Ocean City, a retired captain in the Cape May County Prosecutor’s Office, has served on the board for seven years. She said she wants to continue to help constituents and to fight for the county she loves so much.“We are making strides in Cape May County,” she told the audience. “The airport in Rio Grande and Lower Township – we are pushing for drone industry. We are talking jobs.”Hayes also said the financial state of the county has improved over the years under the current leadership. “We live under a 2 percent cap. We have had the second lowest tax rate in this state. We are doing a phenomenal job.”Like Thornton, Hayes said that the county does a good job providing Fare Free transportation for people in the county.Freeholder candidates debate a wide topic of issues, agreeing on some, disagreeing on others.Gould, who has been a Wildwood Crest Commissioner since 1989, remarked that it is the right time in her life, after serving as a commissioner in her hometown for 26 years and also as mayor, to take the next step in her career.Gould said she knows how to work with constituents, is dedicated to helping people and will do what she can to learn the new position.“The County of Cape May prides itself on the past and looks to the future,” Gould said.Casey, of Ocean City, and is an attorney in her hometown, said she loves the shore.“I love surfing before work, and open spaces,” she said.Casey also loves transparency in government, she noted several times throughout the forum.Throughout the more than hour-long debate, audience members clapped in support of remarks from the candidates.Some things they all agreed on.When it comes to the drug epidemic, they said there needs to be support for people suffering from addiction.“The opioid crisis is awful,” Gould said, adding the importance of Narcan availability to counteract the overdoses. “I see kids, adults – I go to funerals.”Thornton said the Atlantic/Cape court district’s drug court is helping people with addiction and there has been more success this year with 187 people graduating from drug court, a record number.All four candidates strongly supported Cape May County Sheriff Bob Nolan with his stance on ICE and opposing a new directive by the New Jersey attorney general that limits state, county and local law enforcement from cooperating and sharing information with U.S. Immigration and Customs Enforcement.Nolan and Cape May County have filed a lawsuit challenging the directive.The suit claims that the New Jersey attorney general’s order prohibiting the Cape May County jail from screening inmates for immigration violations is unconstitutional and puts the public at risk.Hayes said as a former law enforcement officer, she truly believes in what Nolan is doing.“I support him one thousand percent. I am concerned about you – the community. We are not stopping – if it goes up to the United States Supreme Court,” Hayes said to applause.Thornton said the former county Sheriff Gary Schaffer spoke with him about the issue of illegal aliens going to county jail and then being released rather than turned over to ICE. Thornton said he was, and continues to be, supportive of cooperating with authorities.Casey noted that Ocean County has already joined in the lawsuit and other counties may follow.“I do not oppose Sheriff Nolan,” she said.Gould said she also supports Nolan and the litigation.Also during the debate, the question of nepotism was brought up.Thornton and Hayes were openly at odds over accusations of nepotism earlier this year. Hayes ultimately received a censure from the freeholder board in July for alleged retaliation against a county employee and nepotism accusations involving a relative.The Republican running mates said during the debate that there were no issues between them, and everyone was getting along just fine and it was all behind them.Casey and Gould, though, asserted that the county’s hiring practices should be carefully looked at.Hayes said the key is to look at a person’s qualifications as the main factor in hiring. She added that prospective county employees should not be excluded from being hired simply because someone on the payroll is a relative.Thornton said so long as there is no direct supervision, there is nothing wrong with a qualified relative being hired by the county.After sighting several of the her successful accomplishments in office, Hayes summed up why she wants to continue to serve as freeholder.“Thank you for the first seven years and I look forward to the next three,” She said. “As your freeholder, I fight for Cape May County.”The debate is moderated by the League of Women Voters in a packed room in the old Historic Cape May Court House.Decide for yourself.
